1. Acceptance of Terms
These Terms of Service (“Terms”) govern your access to and use of the website located at internationalcollegecounselors.com (the “Site”) and the services, content, and communications provided by International College Counselors (“Company,” “we,” “us,” or “our”). By accessing or using the Site, submitting information through the Site, or opting in to receive communications from us, you agree to be bound by these Terms and our Privacy Policy, located at https://internationalcollegecounselors.com/privacy-policy/. If you do not agree, do not use the Site or our services.
2. Description of Services
The Company provides college admissions counseling and related educational advisory services, including college selection guidance, application strategy, essay review, interview preparation, and academic planning (collectively, the “Services”). Specific Services are governed by separate written agreements between the Company and the client. These Terms govern use of the Site and communications with the Company. Where a separate service agreement conflicts with these Terms, the service agreement controls with respect to the Services purchased.
3. Eligibility
The Site is intended for individuals eighteen (18) years of age or older. Individuals under eighteen may use the Site only under the supervision of, and with consent from, a parent or legal guardian who agrees to be bound by these Terms. By using the Site, you represent that you meet these requirements.
4. SMS / Text Messaging Terms
This section applies to all SMS and MMS communications sent by or on behalf of the Company.
4.1 Program Description. International College Counselors offers SMS text messaging to individuals who have opted in. Messages may include appointment reminders and confirmations, account and service notifications, responses to inquiries, customer support communications, and marketing or promotional messages regarding college admissions counseling services, events, and offers.
4.2 Consent. By providing your mobile phone number and opting in — through a web form, by texting a keyword to our number, through a written or electronic agreement, or by verbal consent documented by the Company — you expressly consent to receive recurring automated and non-automated text messages from International College Counselors at the number provided. Consent to receive text messages is not a condition of purchasing any goods or services.
4.3 Message Frequency. Message frequency varies based on your interactions with the Company and the communications you have opted in to receive.
4.4 Message and Data Rates. Message and data rates may apply. Contact your wireless carrier for details regarding your plan.
4.5 Opt-Out. You may opt out at any time by replying STOP to any message you receive from us. After you send STOP, you will receive one confirmation message acknowledging your request. 4.7 Carrier Disclaimer. Wireless carriers are not liable for delayed or undelivered messages. Message delivery is subject to effective transmission from your carrier and network availability.
4.8 Mobile Information Sharing. No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. Information sharing with subcontractors in support services, such as customer service, is permitted. All other categories of information sharing exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties.
4.9 Number Changes. You are responsible for notifying the Company if you change or deactivate your mobile number. You represent that you are the account holder or are authorized to consent on behalf of the account holder for the number provided.
4.10 Supported Carriers. Messages are supported by major U.S. carriers. Availability may vary. The Company is not responsible for carrier performance.
5. Acceptable Use
You agree to provide accurate information when using the Site or communicating with the Company, and agree not to:
- use the Site for any unlawful purpose;
- attempt to gain unauthorized access to any portion of the Site or its systems;
- interfere with the operation of the Site;
- reproduce, distribute, or exploit Site content without authorization;
- use automated means to access or scrape the Site;
- impersonate any person or misrepresent affiliation with any person or entity.
6. Intellectual Property
All content on the Site — including text, graphics, logos, images, videos, and software — is owned by or licensed to the Company and protected by copyright, trademark, and other applicable laws. You may view and print Site content for personal, non-commercial use only. No other use is permitted without the Company’s prior written consent.
7. No Guarantee of Outcomes
The Company provides advisory services only. Admissions decisions are made solely by educational institutions. The Company does not guarantee admission to any institution, receipt of any scholarship or financial aid, or any specific academic or professional outcome. Information on the Site is for general informational purposes and does not constitute legal, financial, or immigration advice.
8. Fees and Payment
Fees for Services are set forth in the applicable service agreement. Unless otherwise stated in that agreement, fees are non-refundable. The Company may modify pricing for future Services at any time.
9. Third-Party Links
The Site may contain links to third-party websites or services. The Company does not control and is not responsible for the content, policies, or practices of third parties. Access to third-party sites is at your own risk.
10. Privacy
Your use of the Site and communications with the Company are subject to our Privacy Policy at https://internationalcollegecounselors.com/privacy-policy/, which is incorporated into these Terms by reference.
11. Disclaimer of Warranties
THE SITE AND ALL CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. THE COMPANY DOES NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.
12. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE COMPANY AND ITS OFFICERS, EMPLOYEES, CONTRACTORS, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR OPPORTUNITY, ARISING FROM YOUR USE OF THE SITE OR RECEIPT OF COMMUNICATIONS FROM THE COMPANY. THE COMPANY’S TOTAL LIABILITY FOR ANY CLAIM ARISING UNDER THESE TERMS SHALL NOT EXCEED THE GREATER OF ONE HUNDRED DOLLARS ($100) OR THE AMOUNT PAID BY YOU TO THE COMPANY IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
13. Indemnification
You agree to indemnify and hold harmless the Company and its officers, employees, contractors, and agents from any claims, damages, losses, or expenses, including reasonable attorneys’ fees, arising from your violation of these Terms or misuse of the Site.
14. Termination
The Company may suspend or terminate your access to the Site or communications at any time, with or without notice, for any reason, including violation of these Terms. Sections 6, 7, 11, 12, 13, and 15 survive termination.
15. Governing Law and Dispute Resolution
These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law principles. Any dispute arising under these Terms shall be resolved exclusively in the state or federal courts located in Broward County, Florida, and you consent to the personal jurisdiction of those courts.
16. Changes to Terms
The Company may modify these Terms at any time by posting a revised version on the Site with an updated Effective Date. Continued use of the Site or continued receipt of communications after changes are posted constitutes acceptance of the revised Terms.
17. Severability
If any provision of these Terms is held invalid or unenforceable, the remaining provisions remain in full force and effect.
18. Entire Agreement
These Terms, together with the Privacy Policy and any applicable service agreement, constitute the entire agreement between you and the Company regarding use of the Site and communications from the Company.
